Unhappy Unanswered: Does an Insurance firm mandatorily need an FIR for claims on fraudulent misuse of Debit Card

Hi All,

I am on the look out for some information. Any help on this will be highly appreciated.

Background:
I had reported loss & fraudulent misuse of my Debit Card within 5 days to HDFC bank few weeks ago. I could not get an FIR lodged due to delay/refusal by police but I did get the acknowledgement for the written compliant. I furnished this to the bank and narrated the problems I had in filing an FIR and requested the bank to process my dispute request. The bank initiated my dispute claim process and after 3 weeks (last week) responded saying my claim was rejected as the FIR document was not furnished.

The information that I am looking for is :

1. Does an Insurance firm mandatorily need an FIR for claims on loss & fraudulent use of Debit Card ?
I am not trying to avert lodging an FIR, but would like to know why would an insurace company reject my case for not producing an FIR.

2. How can I proceed with RTI - for the refusal of lodging of FIR by the police ?

Welcome to this portal. Ask the status and copy of FIR that you sent through post. The police deptt. will reply to your RTI query. I think Bank officials are following the Bank guidelines in your case.

Hello Sir, I am so grateful for your quick response. Thank you for the welcome note. After days of hassles in dealing with the Bank and police, today's was an entirely different feeling. Sir, Regarding your response - Just to ensure if I got it right; Are you saying I correspond with the police through post for RTI ? Please clarify.

Dear Rajesh Sambandhan,
RTI will do magic. You ask your copy of FIR and the status of action taken in this regard, they will definitely reply you properly and they will never harass you. It will take one month but you will feel honored in the end. Since your case is under a private Bank and you are a new user of RTI, you may face difficulties in asking the Bank under RTI. However , you can seek information from the Reserve Bank of India under RTI in this regard.
