Appeals from State Information Commission should lie with CIC

Why state IC should be the final authority.
Also I think, One should be given the option of directly lodging a appeal or complaint to CIC rahter than SIC

    Good suggestion. Nowadays authorities who have been asked to pay a penalty, by the SIC, take shelter under appeal to High Court. This can be avoided if the appeal lies with the CIC. Appeals against the final decisions of the CIC may lie with the High Court or Supreme Court.

    The Gujarat Chief Information Commissioner Mr.R.N.Das IAS is not giving the judgments / orders after final hering to both the parties i.e appellant and appellent authorities. My two hearing over in October 2007 but the SCIC not giving the judgments despite repeated requestand his assurences that he will soon give the orders / judgment.
    WHAT SHOULD BE DONE NOW? TO WHOM WE HAVE TO APPEAL? I FEEL ONLY HIGH COURT CAN LISTEN NOW . PLEASE ADVICE. THANKS Dr.R.K.D.Goel VADODARA

    This is a good suggestion. Approaching High Courts against SICs is a time consuming and costly affair. However, you can lodge complaint against SIC with himself under section 18 or file an RTI appln for status and delay with PIO of SIC.

    Dear Dr. Goel
    Try section 6 of RTI act by asking specifically the status of the appeal,developements on day to day basis after final hearing ,and internal guidelines or administrative orders at SCIC Gujrat regarding the time frame for delivering the final Decision ./Also seek information that working at present pace how many more days are required for pronouncing the decision. Be sympathetic to the CICs and SCICs.They are out dated models and as such jerk, and even after push move slowly like old ambassador cars . Ghalib said " agley waqto k hain log unhe kuchh na kaho, saaghar o meena ko andoh ruba kehtey hain means they are conservative persons, donot tell them adverse, they believe that solace can be found in peg and wine"" adil

    Madhumita`s proposal can be sorted out at State level by referring the issue to 2 or 3 member bench of state Info. commission. How many persons can afford to go to Delhi and stay there for one or two days?The expenses involved in visiting Delhi can not be borne by an information seeker.It is better if in case of refusal you approach the High court seeking simple direction for furnishing information by SPIO/AA/SCIC.I believe it will involve less cost. adil

    The answer lies in creating the new posts of Additional Commissioners in the SIC/CIC so that pending cases can be expedited.
