Reasons for decision

RTI Act mandates under section 4.1.d that every public authority shall provide REASONS for its administrative or quasi-judicial decisions to affected persons. I am attaching extract from important judgement of hon'ble Supreme Court of India in connection with reasoning. This can be quoted while applying or appealing under RTI Act.

RTI is for common good of common citizen. I am attaching extract from a very important and useful judgement of hon'ble SUPREME COURT OF INDIA. Members can make use of it by quoting the relevant extract, while filing applications/appeals/complaints under RTI. If PIO or FAA flouts judgements of S.C., the matter may become doubly serious at CIC/SIC or Court level.

  1. Use proper format if prescribed by state govt under its RTI rules, otherwise use format for central govt information available on this site. Details are also available on official website of respective state govts under RTI icon and also on website of Information Commission of the State.

Supreme court on common man

RTI is mainly for the benefit of COMMON MAN of the country. I happened to get extract of a judgement of hon'ble Supreme Court of India as quoted in decision by National Consumer Forum. I append below the extract for information and use by visitors and members of this portal:

How to know Provident Fund Status through RTI?

  1. Send ordinary application as per annexture A below.
  2. If you do not get reply within 30-35 days file application under RTI act as per annexure B.
  3. With annexure B, you have to send Indian postal order [IPO] of Rs.10/- in favour of accounts officer, EPFO [or PF Commissioner, EPFO] payable at the place where application is sent.
  4. IPO is available in nearby post office.
  5. With annexure B also attach self-attested photocopy of annexture A, which has not been replied.

TIPS FOR PIO UNDER RTI ACT 2005
  1. Study RTI Act 2005 and rules applicable to your organization. Please ensure that sections which enjoin certain duties on you are complied with properly by your organization e.g. proactive disclosures u/s 4.1.b etc
  2. Keep yourself updated with decisions of CIC/SIC by visiting their official websites at least once a week. Download important and relevant judgments.
  3. Request your office-head to permit you to attend good training programmes/seminars on RTI.

Section 8 of RTI Act 2005-IMP DECISIONS

Section 8 of RTI ACT 2005

Members may use enclosed decisions of CIC and judgement of High Court while dealing with refusal under section 8 of RTI Act which is routinely used by PIO/FAA. I suggest that applicants apprehensive of refusal under this section, should enclose these decisions/judgement with the RTI Application itself.
