Reasons for decision

RTI Act mandates under section 4.1.d that every public authority shall provide REASONS for its administrative or quasi-judicial decisions to affected persons. I am attaching extract from important judgement of hon'ble Supreme Court of India in connection with reasoning. This can be quoted while applying or appealing under RTI Act.

    Extremely useful post.

    First of all I would like to give you many many thanks.

    I have one suggestion. Please throw some light on following querry.

    If PIO or AA just states a particular section of the RTI as "REASON" for its decision of rejection does it amount to "not giving reasons" ?

    E.g. "We/I have considered your request for information and found that the information falls under sec 8(1)(d) and (e) and is in the nature of commercial confidence and hence rejected."

    Thanks again, very commendable job.

    Either PIO or AA has to furnish the exact reason for denial of information under RTI ACT. You can approach State Information Commission/CIC.
