  1. Not satisfied with decision of information commissioner?

    Large number of appellants/complainants is not satisfied with decisions of Information Commissioners [ICs]. However, since there is no provision of review of decisions of ICs at SIC or CIC level, the only remedy lies in filing a writ petition in High Court. This is costly, time consuming and outcome is also uncertain.

    I suggest that whenever appellant/complainant is not satisfied with decision of an IC, he should represent the matter in personal name of concerned IC, with copy to ...

    I am appending below sections 217 & 218 of Indian Penal Code 1860, which an RTI applicant/appellant or complainant can invoke in deserving cases against PIO, FAA OR INFORMATION COMMISSIONER. Even if these sections are just enclosed with application or appeals or complaint for kind information of addressee, it will have desired effect, since most of public servants are not aware of such provisions. In addition he now knows that you know, what even he does not know !

    Of late, appellants are facing problem of non-compliance/defective compliance of orders of Information Commissioners of CIC or SICs by PIO, FAA and Public Authority. Under such circumstances, the appellant should file complaint with the concerned SIC or CIC, as the case may be. SICs and CIC have no mechanism to ensure that their orders are complied with or not by the respondents.     Format of RTI Application for Information of State Govts, where format is not prescribed under State RTI Rules

    Some states have prescribed format for RTI application under their RTI rules, which needs to be used for that state. Many states have not prescribed such a format. In such cases attached format can be used.
