      POWER OF ONE

A Director (Class-I), Forest and Environment Department [equivalent to rank of Additional Secretary of Govt. of Gujarat] was promoted through bluntant violation of rules of promotion in the year 2003 on adhoc basis. He continued on this sensitive post till today [15-06-2010].

A vigilant citizen Shri Amit B. Jethwa of Khambha village and president of Gir Nature Youth Club [environment NGO] could not tolerate that an officer not eligible for such an important post relating to environment protection, should continue to it. He filed RTI applications with Govt. of Gujarat and Gujarat Public Service Commission and collected all papers and information relating to his promotion. Based on this, he tried to persuade State Govt. to post an eligible and competent person for protection of environment. He knew that entire belt consisting of Baroda, Ankaleshwar, Vapi is engulfed with dangerous chemical pollution and its disaster would be 100 times worst than that of Bhopal.

Since all Govts. now do not understand language other than that of higher judiciary, Shri Jethwa filed petition No. SCA No. 3949 of 2009 under article 226 for quo-warranto writ, in Hon’ble High Court of Gujarat in June 2009. On 15-06-2010 Hon’ble Court issued writ and ordered State Govt. to remove that officer from the post as his promotion was illegal and against rules. Application by concerned officer to stay operation of this order to enable him to appeal in higher court was also declined by the Hon’ble Court.

Shri Jethwa was also instrumental in posting of two additional Information Commissioners in Mar 2010 at Gujarat Information Commission through writ in High Court. He also compelled State Govt. to include postal order as mode of payment for RTI fees/charges in March 2010 through a writ. He has also filed writ for posting of Lokayukta in Gujarat, as post is vacant since 2003. Prior to filing these writs, he had collected information and papers through RTI and based his writs on it.

This shows what ONE MAN can do through RTI.

the media coverage in past month indicates that he is the only known martyr of RTI. i feel RTI has taken a "bali" within 5 years. this is bad.

RTI Applicants in Guj owe a lot to him. May his soul rest in peace and may he get justice as soon as possible.

I wish this state does not have to see any more deaths of RTI Activists.

I have copying the fact to motivate the mass people in our area (WB) to implement RTI.
As our study shows that the mass people has lost faith on govt.-system due to some corrupted authority, as they are in top level and using the public power for their private profit..
so we want more enthusiastic fact from other part of India, to consol them (WB) that anyone can change the situation by the implementation of RTI..
        thanks again..

Shri Amit B. Jethwa was indeed one man army. he did what majority of us would not think of doing. taking on the State Government single handed.& we (citizen of country) are the one's to be blamed for this tragic thing that has happened to Shri Amit B. Jethwa family. as we always depends on other to come & help us without doing our bit. MAY HIS SOUL REST IN PEACE.

This is a story of a martyr for the cause of RTI... His high point of activism was actually the PIL against illegal mining in the Gir area, which sadly brought about his premature death.

He has won his battle against corruption and high-handedness of our existing government officials and quite bravely has faced the dangers associated with it.

I was wondering a different aspect though...

In case of death of an activist, is there someone who can carry the mantle..? Is there people / NGOs / Organizations, who can continue his selfless struggle against the corrupt system..? Are the flames of RTI feeble enough to be doused by the death of its soldiers..? I believe, (forgive my blunt / impolite words), there are many, who has saved the corupt officials through their death..!!

Isn't there any means to bring forward this cause out of the closet and give a destiny to the journey started by several selfless martyrs of cause...?

I can see people praying for his soul to rest in peace... People, all who are sane and cares about our country will pray for each activists who have died for there cause... I highly respect them all...

But Sir(s), I don't want their soul to simply rest in peace, I don't believe they would have wanted to rest their soul in peace... They would have rather preffered themselves to be agitated and would have liked to disturb the peace of those roots of corruption, whom they have fought in their life-time... They would have preffered fight against corruption rather than prayer for their soul...

This might seem to be a emotional and foolish outburst from a common irrelevant citizen like me...

But believe me, its a sentiment which would be shared by all those people, who are still fighting for their causes...

Jethwa's father, brother, and RTI activists in Gujarat are trying to have all Gujarat RTI users body. A conference was arranged in Town Hall of Junagadh on 20-07-2011 [date of murder is 20-07-2010]. On 24-07-2011 a conference is being held at Ahmedabad for this purpose of uniting RTI activists and continue his legacy more effectively. HC has ordered handing over his murder case to CBI. Already 6 persons [including relative of a very influential politician] are behind bar. Conference was widely covered by print and electronic media. I also addressed the gathering. Nearly 250 citizens attended, mainly from Saurashtra area of Gujarat. Some delegates were from Mumbai, Maharashtra also.
