What is malafide denial of information under RTI
The Gujarat SIC had imposed a penalty of Rs 25000 on the PIO for malafide denial of information and because the PIO did not provide information even after the order of the FAA. Malafide denial was attributed since there was other information on record. The Gujarat HC held that there was no malafide denial but the PIo indeed did not provide the information even after the order of the FAA. Hence it reduced the penalty from Rs 25000 to Rs 10000.

| suraj_1511 05-01-2013 at 07:08 PM | In this case it is not clear if the information was denied/not provided for more than 100 days after mandatory period as per law. If that is so, why penalty reduced to Rs.10000 by the Hon'ble High Court? |
