MAHARASHTRA RIGHT TO INFORMATION RULES 2005 1. APPLICATION: The rules provide for a format for application under RTI Act called Annexture A which is appended at column No.9 below. 2. FEES: A. Application fee: Rs.10/- to be paid by bank’s demand draft or banker’s cheque in favour of public authority from whom information is sought or in cash at the concerned office against receipt or by affixing court fee stamp. Applicants holding BPL certificate need not pay any application fee. Court fee stamps are available with stamp vendors or advocates. Court fee stamp is the best way of paying application fee, unless you are filing from other state. B. Other charges: Information in A-3 or A-4 size paper….Rs.2/- per page, Large size: actual cost, publications: actual cost. CD Rs.50/- per CD. Postal charges are extra, unless collected in person. If govt has fixed charges for documents/maps etc, then such charges are payable. Actual Inspection: Rs.5/- each 15 minutes or part thereof with first hour free. Other charges are payable by bank’s demand draft or banker’s cheque or money order in favour of public authority from whom information is sought or in cash at the concerned office against receipt. 3. APPEALS: Rules provide for format for first appeal [Annexture-B]. For second appeal/complaint annexture-C is prescribed. Appellant has to affix court fee stamp of Rs.20/- for first and second appeal or complaint. We may not know in advance about the amount of 'Other Charges' as it directly depends on the number of pages of the information to be given.
1 In such cases I assume that we pay the charges after being informed about it by the concerned information officer. Or do we have to estimate in advance about this quantum and make payment beforehand ? This matter I think has not been made clear.
2 If we have to collect the info in person, how do we come to know that the info is ready ? Do we enquire over the telp, or do the Dept calls us and let us know or do we have to make frequent trips to the dept ?
3 What happens if we make application to the wrong Dept ? Does the Dept forward it to the concerned Dept ? Is there any guideline in such cases ?
4 I want to make RTI Applic to the BMC Office about the bad job done for footpath over the drainage which has gone bad just after 4 months after completion. I want to know who is the contractor, who passed his bills, how much amount is paid, whether there is any retention money, what action is being taken to penalise the contractor for bad work etc. I stay at Dahisar (West) and come under R North Ward. I know the address of the R North BMC Office, but I do not know to whom give the application.
5 Is there any separate RTI rules drafted by BMC ?
