  1. Corrupt officer escapes punishment

    Dear members,<O:p</O:p
    I have submitted few applications to the Co operation Dept of Govt of West Bengal. Particularly against a corrupt officer of that Dept., who was the Administrator of our Housing Society, and was dedicated to serve the purpose of the corrupt managing committee members of this big housing Society with more than 600 members and this is a plot based housing society. The corrupt officer is getting all support from his dept and no proper action was taken with respect to all our complaints/allegations and even the vigilance commission did not take proper action. One concocted and biased so called ‘Inquiry” was conducted by one same Department’s officer , who exonerated that corrupt officer from all allegations. One independent inquiry is needed to examine how the said inquiry was conducted to save the corrupt officer.<O:p</O:p
    One of our member submitted the following application to the Dept State Public Information Officer.<O:p</O:p
    On the Salary bill for the month of Sept, 2003, prepared by the Accountant on September 26, 2003 Dr. Surath Biswas, the then Administrator of Metropolitan Co operative Housing Society, put his signature with order “passed for payment of Rs. 6,200.00 (Rupees six thousand two hundred) only.” He clarified his order saying “the application was submitted to the appropriate Court bearing CAN no.8180 of 2003 in FMA NO. 1230 of 2003 by the undersigned administrator and the matter was heard on 22.09.2003, when Mr. Dhilon Sarkar Ld. Advocate raised the question of enhancement of pay of the employees but the C. J. & the other Ld. Judge of the Division Bench set aside the objection and supported the expenditure towards salary as the office shall remain open on all working days as per State Govt. notification and it was necessary for day to day function and preparation for the election of the society and it is now being done as per order of the administrator no. 3 dtd. 02.09.2003. Accordingly the bill is passed for payment.”<O:p</O:p
    But it was clear from the order of CAN 8180 of 2003 there was nothing regarding the enhancement of salary of the employees of this Housing society. So this was clearly a false statement.<O:p</O:p
    1. Did the RCS consider that this was an illegal and/or unethical activity on the part of Dr. Surath Biswas? <O:p</O:p
    2. What action was taken against Dr Biswas by the Govt. authority for this type of activities ? <O:p</O:p
    3. If not taken , when it will be taken? What was the reason of not taking proper action against him?<O:p</O:p
    The information received is given below.<O:p</O:p
    The statement made in the paragraphs 1 &2 are the applicant's own understanding of the matter and this Directorate has nothing to comment.<O:p</O:p

    Accordingly the information provided is appended below-:<O:p</O:p
    1.There is nothing on record to show that that the Registrar of Co op. Societies , <ST1:pWest Bengal</ST1:p considered the activities of Dr Surath Biswas as illegal or unethical.<O:p</O:p
    2. Does not arise in view of the reply to the query no -1<O:p</O:p
    3. The question of taking any action at this point of time does not arise in view of the reply to the query no -1<O:p</O:p
    Signed by the Registrar of Co op. societies W.B Dr Surath Biswas.<O:p</O:p
    But we have some thing to comment
    The striking feature is that the complaint was against the then Joint Registrar & the then Administrator Dr Surath Biswas----- and "information" provided by the same person Dr Surath Biswas who got two promotions of "successful corrupt practice " as our Administrator( Detail is not possible to<O:p></O:p>
    Now my clarification is as below-<O:p></O:p>
    1.The clear xerox copy of the statement given in the 1st para of the then Administrator Dr Surath Biswas is with us and which has been provided along with the next application <O:p></O:p>
    ( with his specific signature which was prominent both in that statement as well as the information provided by him as Registrar)<O:p></O:p>
    2. The above mentioned High Court's Order (CAN 8180) did not at all reflect that enhancement of the salary of the Co op. staff was supported by the Hon'ble Chief Justice and his companion Judge. ( This has not yet submitted-- it will be submitted in the next application) <O:p></O:p>
    So the very first comment of that corrupt person as the Registrar--"The statement made in the paragraphs 1 &2 are the applicant's own understanding of the matter and this Directorate has nothing to comment " does not hold good at all as explained above.<O:p></O:p>
    In the next application clear Xerox copy of Dr S. Biswas was enclosed and information sought for whether there was any mention regarding the enhancement of salary of the Co op staff in the High Court Order (CAN 8180 ) as claimed by DR S.Biswas in his statement mentioned above.<O:p></O:p>
    The Dy. Registrar of Co op Societies furnished the information as below:-<O:p</O:p
    1) Yes, there is a copy of the order of the Hon’ble High Court , Kolkata bearing CAN No 8180 of 2003 in FMA No 1230 of 2003available in the relevant file of the Society. No explicit directions in regard to payment of staff is there in the order. <O:p></O:p>
    In my earlier RTI story dt 03/10/07 I mentioned that this corrupt officer conducted election in Metropolitan Co op Hsg , completely violating all the directionsgiven by Single Bench Division Bench of Calcutta High Court as well as he did not obey the Apex Court’s order also ( which I forgot to mention in my earlier story )<O:p></O:p>
    The Department with its able Minister exonerated Dr Surath Biswas from all illegalities. Our case against the election is still pending. <O:p></O:p>

    across india, It seems all RCS officials corrupt?
    In New Delhi, National Capital an Registrar of Coopertive Society is also rated one of the TOP corrupt office.
    I personally expericed their inefficiency for over 3 years now.

    Dear Rejimonck,
    We are lucky enough to have experience of 24 years of different corrupt RCS in our state( excepting a very few ).

    One of the ex Principal Secretary admitted that the deprtment of co operation has become the department of"Corruption" . As he was a very honest and upright IAS officer , he was immediately removed from the department by the MINISTER--- Any thing to comment ?--- Abhijeet

    Dear friends,
    Now a days so many investigation agencies are available where we may approach to fight against corruption. Society at large is also not favouring the corrupted persons so we may win against these fellows if we work like a journalist or detective. Dear friends you are actually facing the problem of negligence and as the whole atmosphere is recognising evrything in the name of corruption. Please think that if every organ of Govt is vigilant and devoted with his duties whole mechanism will correct. The ultimate protector of constitution is not working properly so no one is thinking to do duties with responsibilities and no one is treating public as own public.

    there may be few brave officers, hardly they get support of public and media.
    i agree with you. In the National captial our RCS(New Delhi) recently was in news may be aware of the scam worth over 4500 crore ? Including Registrar and many are inside the jail, CBI and Delhi High court is dealing with them.
    However, nothing has changed..Its the story of DOGs Tale...

    One of our members submitted the similar application u/s 4(10(d) and wanted to know the reason why administration did not take any action against that corrupt officer . After 45 days the reply sent as--- The concerned officer was appointed through the High Court and he submitted one compliance report to the High Court. So the Department had nothing to do.
    1st appeal was submitted elaborating the matter, but no change in the stand of SPIO. We had to to wait for the 2nd appeal .
    But my point was 1) Did High Court categorically directed the said administration to take proper action against the corrupt officer ?
    2) Submission of "compliance report " to the High Court is the sufficient to exonerate hom from the corrupt charges ?
    3) Did the High Court supported the action take ( written false statement to suggest that High Court had provided a specific order, which was not at all in the concerned judgment ?
    4) Was there no departmental procedure to take action of this type of corrupt practice ?

    The only one reply was provided durimg appeal hearing that they had nothing to comment further.
    We are waiting for the decision of the departmental AA , then the next step is to be taken.
    This is mentioned here for valued opinion/suggestion from able RTI activists of this forum

    Keep on keeping on. 60 year corruption will take time, but if followed up by group of honest people, things will change. Let honest people unite, as the corrupt have united for saving the corrupt officers.
    It takes each of us to make difference for all of us.
