  1. Query related to second appeal to CIC


    Hi,

    - Is filing second appeal to State CIC free or do we have to pay some fee?
    - In whose name the DD or postal order has to be taken in case fee has to be paid?
    - If we are not satisfied with the decision of State CIC, can we appeal to Central CIC? Any fee to be paid that time?




  2. Visit the official website of the State Information Commission and acquaint with -

    [1] format of appeal
    [2] documents to be submitted with appeal
    [3] applicability of SA fee and its mode and method of payment, if so.
    [4] verification and affidavit etc
    [5] mode of submission.

    Further if we are not satisfied with the decision of State SIC we can not appeal to the central CIC. CIC is not superior to any state SIC. In this situation we have to approach to respective state High Court by way of writ petition.

  4. Any appeal against decision of either State IC or Central IC is only through writ in High Court alone.
    If the matter is worth (Importaant and urgent) writ in state HC is the only alternative. IC may not be a party in the writ.

    for the second appeal you are not required to pay any fees SIC office.

    May I also ask you whether it is a must to send a copy of Second Appeal to First Appellate Authority (FAA), before sending it to State Information Commissioner (SIC) or to Central Information Commissioner (CIC)?

    There is a time frame for filing second appeal. One has to send the copy of appeal to PIO by regd post and mark the proof of serving (Copy of postal receipt) as enclosure to Second appeal. It is sufficient if a copy is sent to PIO, as PIO is the only accountable authority under RTI.
