    Maharashtra BPL applicants have to pay for photocopies above 50 pages


    "The BPL applicant should be given access to desired information free of cost. The BPL applicant should be requested to visit office of public institution concerned (for file inspection). If the number of pages is more, the applicant should be provided upto 50 photocopies without any charges. If the number of pages is more, regular fees be charged," Rajendra Jadhav, deputy secretary of GAD, said in a latest circular.

    Whether he can violate such stipulation as stated in RTI Act or not is to be discussed by experts for academic interest.
    (The issue raised is in particular to HC stipulation for collecting RTI fee at higher rates even from BPL applicants, when Act stipulates that no fee should be collected. When HC can violate, why not others ?)

    Someone should challenge this circular in court.

    It clearly violates the "proviso" to sec 7(5) of the RTI Act.

    7(5) Where access to information is to be provided in the printed or in any electronic format, the applicant shall, subject to the provisions of sub-section (6), pay such fee as may be prescribed:


    Provided that the fee prescribed under sub-section (1) of section 6 and sub-sections (1) and (5) of section 7 shall be reasonable and no such fee shall be charged from the persons who are of below poverty line as may be determined by the appropriate Government.

    I have filed RTI application to SPIO, APHC and received a reply that they are actively considering to waive such fees, and this was in 2010. May be the matter is adjourned. Atleast happy with our APHC they are collecting Rs.25/- and there were some HCs that prescribed even Rs.250/- fee for all RTI Applicants.
