  1. RTI Application Transfer to more than one Public Authority


    Sir,

    PMO office advisory reads as follows vide https://www.pmindia.gov.in/en/advisory-for-information-seekers-rti-applicants/

    b) However, the applications for obtaining information which pertain to Multiple Public Authorities (e.g. involve more than one Ministry/ Department) shall not be transferred to such other Public Authorities and the request of the RTI Applicants in such cases, is liable to be rejected.

    1.Does the above rule holds good for PMO office or every competent authority?

    2. In case of rejection, is there any time limit to inform the applicant by PMO?

    3. How will the applicant know that his queries are related to more than 1 public authority and how he would re-apply again?

    1.There is a CIC decision that application has to be filed before concerned PIO and it is the responsibility of applicant.
    2.Any denial can be done within in one month . In case of rejection also the same rule is at present being applied.
    3.Applicant should have basic understanding as to where he can get the information and the concerned public authority. Because an applicant is not knowing any public authority, dumping all applications to PMO stating that he can exercise Sec.6 (3) may appear funny.
    To sum up applicant must be having working knowledge about the source of information (Custodian/controller of that relevant record)

    mixing up different subjects like police , municipality, education etc., amounts to rejection as they are independent departments and the got their own PIOs similarly for PMO ,asking about the ministries other than those held by the PM will come under different subjects which the applicant must know . in case of rejection they will intimate the applicant about rejection.
