    First appeal through email


    dear experts,

    Can we send the first appeal to the email address of the appellate authorities.

    any,known precedences in this regard

    Respected Member,
    You yourself have good exposure. It has been discussed many times in blogs & closing threads that it is better to file by REGD./Speed Post as Dak Receipt/Dispatch sections are separate & they enter in register & obtain receipt from the concerned person.
    In RTI Act-2005, it is not referred as to how it should be sent. But during appeals, it is applicant to establish that it was sent & received.

    Appeals can be filed electronically also.
    There was a good judgment obtained by one of our Member Shri Sharma from Rajastan HC.
    But, experts in the forum always advise not to enter into arguments/controversy and follow traditional way of sending the same by Regd. post, as service proof of filing first appeal is required while filing second appeal.
    (You may file first appeal electronically and then send hard copy by Regd post, preserve postal receipt by pasting on copy of your first appeal, as it is required for second appeal)
