It is generally stated that unless penalties are imposed for refusing to give information to the applicant within time, the RTI Act will not be very effective. Itís true to a great extent. However, if the response to show cause notices in many cases show the reasonable cause, penalty cannot be imposed.

But, there was another decision that if the information was already provided, CPIO can provide such reference to the earlier information given on that issue, if possible a copy of such reply. Without this reference simply saying that information was provided already hold no water. After all it is at the end IC discretion considering material facts.
