    Another RTI application returned


    An advocate filed an RTI Application Annexure "A" (see rule 3) with affixed court fee 10 rupee stamp to Tourism Officer/PIO.

    While the original RTI filed was not returned (and the advocate does not have a copy of it) a letter from the Disst. Tourism Dev. Officer, Kangra at McLeod Ganj wrote to the advocate requesting application on the prescribed proforma along with original treasury challan to the tune of rupees ten and enclosed a xerox copy of the prescribed proforma for further action.

    The proforma is Form 'A' (see rule-3(1)).

    Now, how to get back the original RTI filed since we don't have a copy of it and proceed further?

    As a rule the PIO is not supposed to return your original application form, without any valid reason, on the pain of being penalied by the SCIC / CIC as the case maybe. However, I am unable to understand, why do you want a copy of the original RTI Application?

    If you need information, make a fresh application attaching the prescribed fee of Rs.10/-. Use of advocates for seeking information under RTI is discouraged by the CIC. Its better if the applicant files the application in his own name. The act has been promulgated for the benefit of the citizens, who otherwise cannot afford the high fees of advocates etc.

    Secondly, if the need of copy of the original form, is great, file another application asking for the copy of "that" application form ;-)
