    Bhopal: The Government officials file the majority of applications received by the Central Information Commission (CIC) under the Right to Information (RTI) Act, 2005. The cases of promotion, salary, transfer and related matters come in huge number before the Commission for hearing.

    These facts have been made public by O. P. Kejiriwal, member, Central Information Commission, New Delhi.

    "Eighty per cent of applications filed before the CIC are from Government officials, either serving or retired", said the Central Information Commissioner.

    Kejiriwal emphasized that the RTI Act, passed by the Parliament of India in the year 2005, overrides all the existing Acts of the land, even the Officials Secrets Act, 1923.
    "The applicants should file in very short and crispy application instead of detailed description in order to save the time of Commission and the applicant himself/herself", Kejiriwal appealed.

    The Information Commissioner was speaking at a Media Workshop organized on Right to Information at the Academy of Administration, Bhopal on Saturday. It was organized by Department of Journalism, Makhanlal Chaturvedi National University of Journalism & Communication, Bhopal.

    Speaking on the occasion Chief Information Commissioner of Madhya Pradesh State Information Commission, P. P. Tiwari said that there is a greater need of awareness among the people regarding this right.

    “In coming days the facility to file an application through telephone under the RTI would be possible through out the country”, he said.

    Although the Act has empowered the people at great extent but still there are so many hindrances in this regard, Tiwari added.

    Comparing the functions of Central Information Commission with the Press Council of India, another major institution established by the act of Parliament, Achyutanand Mishra, a veteran Journalist and the Vice-Chancellor of Makhanlal Chaturvedi National University of Journalism & Communication said, “Unlike the PCI, the CIC is empowered with the penalty chagrining authority”.

    It shows that so much unsatisfaction in Government Employees which was at the time of British goverment. The naxalist is result of unsatisfaction of Govt employee and we will have to face one more revolution. The Govt must think to make system of employee managment transparent. We may make a policy to retire such Govt servant who is acting to take the rules in hand.

    Dear SNGupta ji,

    Govt. Employees themselve's are reaping all the benefits of RTI to the hilt.
    But when it comes to Public the same Officer's don't allow them to reap
    any benefits at all, creating all sorts of stumbling blocks on the way.

    The Govt. Employees should be more sensitive on the Public's right to information.

    Mr Sidmis,
    There are so many Govt employee and only 20 percent employees are being adjusted in system and they may used in public interest. The Govt employee who has lobbing may not favour any act of tranparency because they are enjoying Govt like proprietor. We must support the user of RTI if they are Govt employee because they only open the door of RTI. Every Govt employee is not in position to over rule the rules only some Govt employee having powerful lobbing are acting adverse to indian public. If we will treat all Govt employee as one society and will not favour the RTI users who are Govt employee them whole RTI will end in the books. Please think once again it is my experience.

    Once bitten, twice shy. This is too sensitive a topic to pass any comment as most of the netizens on RTI including me are government servants, serving or retired. Any adverse comment against government servants, irrespective of the hard realities are likely to invite wrath of all Activists. Still, can't we think of the present cituation where 80% of the CIC's capacity is utlised by government servants who are not likely to exceed 5% on issues concerning their service matters.Is no other government machinary available to them to resolve such problem ? Whatever little knowledge I have on service rules, the system has a built in scope for redressal of grievences. A honest and impartial comment on the issue is solicited.

    colnrkurup, you hit the nail on the head !
    Because there is no quick, transparent and effective mechanism of grievance redressal for Govt. employees (serving and retired), they have no choice but to resort to RTI. Even if a employee writes a letter to his pwn department, there is no answer...what does he do then ?
    Since June 2007, I have tried to read most of the decisions of the CIC, since I store the important one's for future reference on my hard disk, duly cataloged. By reading the facts of the case and the type of information asked for, one can very easily judge whether the "employee" or "ex employee" has been unduly victimised/harassed for something that he could have done in the past. Maybe he tried to highlight some corruption or highlight something irregular in the department...those are the employees who have to resort to RTI.
    There are very few grievance related cases (at least since June 2007) wherein the matter has gone to the CIC when it did not deserve to do so or it could be termed as "frivilous".
    But it is a fact that Government employees are the biggest users of RTI, whether in the Centre or in the States.

    There is nothing wrong if the Govt employee uses the RTI. What needs to be done is to make other citizens also to use the Act for their benefit. If we expect Govt employees to do it, we will only be disappointed. Such awareness among the public can be created by activists only. If we look at it the other way, we can see that once the Govt employees taste the benefit of RTI they will also implement it properly and become more responsive.

    The mechanism of RTI in Govt department may only be developed by Govt employee. If the Govt employees will not use RTI there will be no mechanism and if any person will come to give application under RTI, he will be returned back due to lack of mechanism. We all activist must support to use RTI by Govt employee so that the RTI mechanism in department may be available for a general person also.
