    If some institute not follows the Section 4(1) (b) of the RTI Act 2005 what action can we take? and how can i know the Appelant Authority?

    vedvrat s, no punitive action can be taken against the institute for not complying with sec 4[1] [b] of RTI act. if the issue is agitated in the media and other public forums, the lapse is often rectified.

    You can complain to CIC/SCIC for non compliance of sec 4 [1]
    It takes each of us to make difference for all of us.

    Thank a lot for your kind attention, the institute is a deemd university financially aided by UGC.
    If there is no punitive action than this will be a great escape route.

    Once you are sure of the institution status, a complaint to CIC would atleast open up the doors of setting up of RTI enforcement system.

    1. Unfortunately no action can be officially taken against the PA for
    not disclosing information under Section 4.
    rtiindia.org is having a proactive disclosure campaign under Section 4.
    You can use the format therein to apply to the PA to check if they are
    implementing Section 4.

    2. The PIO should inform you in his reply as to who is the Appellate Authority, his contact details and the time limit for First Appeal.
    If he has not done that, you can check with him or a board displayed in the PA for details of the AA. If that is also not successful, then you can submit your First Appeal to any officer higher in rank to the PIO or even to the Head of the PA. Clearly mention in the First Appeal that you are doing this (submitting to any higher officer or Head of PA) because details of AA were not given to you by the PIO and nor are they easily available elsewhere.
