    Bureaucracy makes a mockery of RTI

    The bureaucracy in Haryana has virtually reduced the Right to Information Act to a toothless law, which is being observed more in its breach than observance.

    The most common ploy used by bureaucrats is to supply misleading or contradictory information to those seeking information under the Act. The other standard gambit is to force the applicant to move the appellate authority, thus passing the buck upwards.

    RTI activists allege that the dilatory tactics of the senior bureaucrats has over a period shown the way to junior officers to follow suit and harass applicants. This has led to a sharp increase in the cost of seeking information.

    An avid RTI activist, Anil Bhatia, says he has been fighting against the control being exercised by the DAV Colleges Management Committee based in New Delhi over its colleges in Haryana for the past 20 years. After the RTI Act was implemented, he had hoped to get information from the government and the universities.

    However, the bureaucracy has been thwarting his efforts by refusing to part with right information or out rightly denying the same forcing him to go in appeal. “The effective cost of seeking information has skyrocketed because of the unnecessary exchange of letters and the cost of travelling to Chandigarh for the hearings of my appeals,” he says.

    Here is an example of how the bureaucracy hoodwinks applicants. Bhatia asked the higher education commissioner, Haryana, whether the government had approved the appointment of a principal of DAV College, Ambala, by way of transfer and if so under what law.

    He was informed that a copy of the letter rejecting the request for approval of this appointment was enclosed and a copy of another letter granting the approval was also enclosed. He has not so far been apprised of the rules under which the approval was granted.

    A local resident, Dr Dharambir Singh, asked Kurukshetra University under the RTI Act whether the Delhi-based DAV Managing Committee was the competent authority to appoint and punish a principal or lecturer of Dayanand College, Hisar. The reply was “No”. He was also told that the varsity only recognised governing body of each aided DAV College and not the Delhi-based organisation.

    Dr Dharambir Singh says despite this the university is granting approval to appointment letters issued by the Delhi-based committee which prescribes its own rules and regulations for the employees, contrary to the Haryana Security of Service Act for aided colleges’ employees.

    RTI activists say the authorities are wreaking vengeance on applicants seeking information under the Act. Dr Ved Pal Singh, a senior professor at Haryana Agricultural University, here was transferred to a far-flung town after the he relentlessly pursued his application for information regarding certain appointments.

    Bhatia said the stubborn attitude of the bureaucracy has also turned the Act into a money-spinner for their offices despite denying right information to the applicants.

    Not only haryana every where the beurocrates making the RTI as mockery. Only punishment to beurocrates may make RTI usefull. Negligence must be treated as crime and punishable as malafide.

    aapka kehna bilkul sahi hai...
    lekin aajkal ka latest trend bhi thoda dekh lijiye....RTI ke aane ke baad se govt ki raftar mujhe lagta hia thodi dhili ho gayi hai...

    dekhiye har govt office mein ek rti branch khul gaya hai..us branch ke liye koi naye log to recruit kiye nahi....so purane logo se hi kaam chal raha hai...
    so effetively govt par revenue expenditure padh gaya hai which is not productive...
    aajkal aap rti application dekhoge to dang reh jaoge......10 rupaye mein janta phd kar rahi hai...
    ek mp ka lawyer hai...usne ek bpl card holder ka naam uthakar desh ke sabhi collectors se aanganwadi sevikaon ka 1990 se abhi tak ka naam aur pay manga hai...

    mujhe to lagta hai ki govt ko sara kaam chodkar na rti ka jawab hi dete rehna chahiyel....

    sarkar ke paas bhale hi stationary ka paisa ho ya na ho...rti ka jawab kis na kisi tarah to degi hi..
    aur itne innovative desh mein..ek pura business model hi taiyar ho gaya hai...
    aap kya kehte hain????

    Dear sagginyou,
    Thank s for view expressed. This is bad luck of this country that theives are very smart. They are capable to establish that the information with regards to theft may not be possible. In this age of computerisation every information is possible in seconds. Secondly to sell information in the cost of Rs. 10 or higher is not so less. You please so survey so many persons in country earning their livelihood by selling bidi cigarette gutka in the cost of Rs. 1 only. What they are earning to sell a Gutka is also surprising. Information need not to be created it should be existed as whenever the money comes in or goes out we have make some records. That records is only to be provided to information seekers.

    1. Is desh ke nagrik ne to kabhi bhi nahin RTI banaya.
    Govt. ne hi banaya. Hamare chune huye pratinidhiyon ne usko pass kiya.
    To ham bechare nagrik ko dosh kyon de rahe ho ? Govt. ne hi tay kiya ki 10 rupaya dena padega...to hum de rahen hai. Aur kya karen...jyada dein kya ?

    2. Yeh desh mein to Govt. ki raftar hamesha se hi kam rahi hai.
    Pehle aag lagti hai aur phir fire engine kharidne ka plan banaya jata hai.
    Pehle Hydrerabd aur Bangalore Airport pe plane utar jata hai aur phir hamen maloom padta hai ki wahan tak pahunchne ke liye sadak hi nahin hai. (AP ki sarkar to kahti hai ki agar sadak nahin hai to hum helicopter seva shuru karenge.....thik hai , agar roti nahin mili to pastry se kaam chala lo.)
    Aaapki yeh galat soch hai ki RTI ne Govt. ki raftar kam kardi hai. Jab traffic hi slow hai top speed breaker lagane ka sawal hi nahin uthta.

    3. Govt. hamesha chahati hai ki hum sabhi nagrik niyamon ka palan karen. Hum isi RTI niyam ka bhi palan kar rahen hai...usme kya galti hai hamari ? Govt. ke karamchari kyon palan nahin kar rahe ? Woh bhi to nagrik hain. Nagrik ka duty hai ke woh sabhi niyamon ka palan karey.

    4. Govt, ke paas keval stationary ke liye nahin, bahut aur chizon key liye bhi kharch karne key liye paisa hai. Keval beech mein khana pina band ho jaye to Govt. khud hi bahut bada business kar sakti hai.
    Kitna Govt. kharcha is productive ?

    1. The citizens of this country never made RTI.
    Govt. made it and our elected representatives passed it into law.
    So why blame us poor citizens ?
    Govt. decided that we should pay Rs 10.00
    So we are paying that. What should we do...pay more ?

    2. In this country the pace of Govt. has always been slow.
    The building catches fire first and then we think about making a plan to buy fire engines.
    Hyderabad and Bangalore airports have planes already landing and then we realise that we do not have a road to get to them. (AP Govt. says that if there is no road, we will start a helicopter service.....ok, if we do not have rotis to eat, we will eat pastries instead). It is incorrect for you to say that RTI has reduced the speed of the Govt. When the original speed itself is slow, how can anything act as a speed breaker ?

    3. Govt. always wants its citizens to obey all laws.
    We are obeying this law also in letter and spirit.
    Then, why aren't Govt. servants obeying the same law ?
    They are also citizens.
    It is duty of citizens should obey all laws.

    4. Govt. has enough money , not only for stationary but also for many other things. If the "khana-pina" is stopped the Govt. itself will have big money to run a business. How much Govt. expense is really productive ?

    "In this country the pace of Govt. has always been slow".
    Shri Karira ji your this observation is excellent. The slow speed is only reason of corruption and mismanagement of country. Think that if time of train is 7 P.M. and if we are reaching to Railway Station at 8 P.M. we may catch train. Ask the question to the public servants. In Govt negligency is so much prevailing and they have so many reason to explian his negligency. We have to fight against negligency and un accountability to make our country heaven.
