Social welfare penalised Rs. 25,000 under RTI Act

IMPHAL, Mar 4: The Manipur Information Commission has ordered the state social welfare department to pay Rs. 25,000 as penalty for not providing information sought by an applicant under the Right to Information Act, 2005 which is in force in the state.

The order of the commissioner was issued yesterday asking the social welfare department to pay the fine within 15 days under section 20 of the RTI Act, 2005 from the date of issue of the order for not furnishing the information or for malafidely denying the information under sub-section (1) of section 7 of the Act.

The chief information commissioner, RK Angousana gave the ruling responding to an application filed by one Bidyabati of Wangkhei Palace Compound, Imphal east stating that the information which was supposed to be provided under the commission`s order on February 12 this year has not been provided by the social welfare department.

The SPIO did not submit any reply to the commission`s show cause notice even after 15 days from the receipt of the same apart from not responding to the call from the SPIO again fixing on March 1 last as the last date for submission of the same, the commission said.

Following the non-compliance to the commission`s order, the commissioner Monday gave his ruling to impose penalty of Rs. 25,000 on the directorate of social welfare.

Following the non-compliance to the commission`s order, the commissioner Monday
gave his ruling to impose penalty of Rs. 25,000 on the directorate of social welfare.

Who will Pay the Penalty? SPIO or the Directorate?

If it's the Directorate then it's the Public Money going to Public exchequer.
    So no harm done.

And the erring SPIO got off scot free.

Is there any provision in RTI Act for a Public Authority to pay Penalty?

    Sidharth,

As per the RTI Act, penalty can ONLY be levied on the PIO.
However, compensation can be given by the Public Authority.

From the news report it is not clear as to who is being penalised. Probably the detailed order of the SIC will have clarity on this aspect.

In any case, what is the big point of the PA paying a "penalty" to the exchequer ?
    As they say in Hindi:

Kuan ki mitti, kuan mein hi gayi !

I guess it is only PIO who is supposed to be referred to in the decision not the department.
