    You can file a RTI Application with UP AWAS ans ask whether the circular posted above has been amended or not and ask for certified copy of the new and amended circular.

    UP AWAS or any other Public Authority does not have any powers to decide who is a Public Authority and who is not. That power lies exclusively with the SIC/CIC, or at a later stage, with the High Courts.

    One member in our Co-op Housing society ( NOIDA , UP ) filed and RTI complaint in 2007 to society's Secretary. That time Secretary rejected the application stating that he is not bound by RTI act to respond. Now the same member has filed another compalint after we can to know about the Housing Commissioner's order (which is available in this blog page). As per that order the Secy is the PIO for our soceity. A copy of that order was also enclosed with the latest RTI compliant. This forced the secretary to respond. In his reply, he has asked the member to 800/-as the photocopying charges of document. The issue here is that the Secretary says he will have to make three sets of docuemnts, one for the compainant, one for the Co-op Officer of UP Govt and one for the Housing Commissioner. ANd the Secy is demading 800/- as photocopying charge for making three sets. My doubt is that why the complainant shoul pay the photocopying charge for making additionel sets.? Is the Secy making things complex? Is it necessary to give copies to other Dept Official when they never asked for such documents..

    RTI is used to submit applications for seeking information. An RTI application is not a complaint and the person asking for information is applicant and not complainant.
    The applicant is required to pay only for the copies he gets and is not concerned with other office procedures.

    Sir,

    I was very happry to read the office order posted at #6. But when started acting on it, only then, I realised that the babudom has worked overtime to make that order invalid. Enclosed is a copy of UP State Information Commission order ruling that the Co-OP housing societies don not come under RTI.

    When other states are bringing co-op housing societies under RTI, in UP the reverse is happening. Some body wants to give a slow poison to RTI act in UP.

    Can anybody suggest what future action can be taken to get the RTI Act implemented for co-op housing societies in U P
