    Hindu succession Act 2005-need clarification


    Subsection 1 of section 6 Hindu succession act 2005 provides that from the commencement of the hindu succesion act 2005 daugthers have birth right as that of the son, and also provides partition made before 20.12.2004 shall not be disturbed.Hence it is clear that the daughter has equal right as that of the son in the undisturbed coparcenary property lying after 20.12.2004.But subsection 3 of 6 provides the share of deceased male hindu is ascertained on the basis of death date. Is this not a contradiction? Intention of the law maker to give equal right to the daughters from the commencement of the Act i.e.9.9.2005 is defeated. Please clarify.

    Sathya,
    Please note that the female who expired before 9/9/2005 had no share in the joint property at the time of her death. However, if a female expires after 9/9/2005, her share will be determined like any other coparcenar. There is no discrimination after 9/9/2005.
