    NEW DELHI: An Information officer�s plea that he was a �technical person� who received no training on the RTI Act did not help him escape penalty imposed by Central Information Commission (CIC) for delaying information sought by an applicant.

    Chief Information Commissioner Wajahat Habibullah turned down the appeal by M L Kumbhare, Director of Geological Survey of India (GSI), who sought exemption of the penalty imposed on him for the delay in responding to an RTI application. �It is clear that no new ground has been provided to us to substantiate any reconsideration of penalty in this case.

    It is an admission of incompetence and systematic weakness in his department,� the CIC said in a recent order. �Although we may have every personal sympathy for Kumbhare, we are constrained to confirm the decision already pronounced,� Habibullah said, directing GSI headquarters at Kolkata to initiate recovery from him.

    Kumbhare, through a representation in the first week of April, sought a review of the CIC�s earlier decision to impose a penalty of Rs 17,500 against him.

    He claimed that he was a technical person involved in research project of the GSI and no training has been imparted to him on the RTI. Further, Kumbhare said that he was not a qualified person in law and had not even attended any seminar or workshop of RTI.

    He also complained that he had not been provided with any staff by the authorities. His pleadings, however, failed to move the CIC, which held all Public Information Officer are in fact designated for the purpose in addition to their own duties. It is for the department to consider strengthening its machinery, the commission added.

    Kumbhare,Director GSI, pleading.
    That's the level the authorities have succumbed to?
    !. I wonder if any of us have had any formal training on RTI?
    2. I wonder how many of us are qualified lawyers?
    3. I wonder if any of us has any staff to seek RTI information,prepare cases,journey across hundereds of kilometers at short notice(at times without notice) on our own meagre resources, and argue cases in most hostile environments ,facing the most qualified govt machinery. And ,beauty of it,still win.
    No Mr Kumbhare,you must pay for your mindset.

    I have the following few questions for such Govt. officials who do not get any formal training in RTI Act :

    1. Where from these officials get training on corruption.
    2. Delay tactics while refusing to reply the RTI Applications.
    3. Shifting on the responsibility to others.
    4. If one can count one's salary well, one can do any job in any position.

    Good job done CIC keep it up.

    Anyone who can ... in public can also answer anything asked by public...
    RTI should be seen in that perspective...
