CIC Mr. Wajahat Habibullah's decision pre-empts denial by PIO......
In a order dated 24 April 2008, CIC Mr Wajahat Habibullah, has nicely pre-empted any chance of denial by the PIO, on certain grounds under Sec 8.
Matter is regarding disclosure of Salary:
The Commission has decided to treat this application as a
complaint petition u/s 18 (c) of the said Act and hereby directs the CPIO, 6,
Sikh LI, 56 APO to provide the information sought, within the limitations
mandated by Sec 8 (1) of the RTI Act, 2005 to applicant Smt. Shalini Rajput
within 10 working days from the date of receipt of this decision. It is
however, clarified in case of doubt that no exemption may be sought u/s 8(1) (j)
of the Act as payment of salary for any public servant is information in the public
domain warranting suo moto disclosure u/s 4 (1) sub section (x)
