    My suggestions for having the CPIO and the FAA from another department is for maintaing impartiallity and independence (without fear and favour). In the present system a CPIO and FAA cannot afford to displease his superiors (public authorities). Hence in the present system the CPIOs and FAAs are not assertive for implementations of the povisons of RTI ACT-2005, particulrly in cases where the info asked is "uncomfortable".

    The custodian only knows, where the particular information is available. In case CPIO is from other department, than our great BABUS will never co-operate him and a chaotic situation will arise at all the public authorities.
    The need is the FAA must be judicious in discharging his duties.

    Dear Mr. Khemani,
    The CPIO necessarily may not be the custodian of info sought.
    The role of a CPIO is to ask the PA to supply info to him as per the provisions of RTI ACt-2005. Even if a CPIO knows where the info is located he cannot himself "snatch" the info from PA to give it to the applicant.
    It really does not matter whether the PIO knows or not where the info is, his job is to ask the PA of that "particular" office to provide info to him and transmit the same to the applicant.
    So having a PIO from the same department really dpes not matter.
    We need an assertive PIO and in the present system it is not possible. Hence my suggestion is to have PIOs and FAAs from outside the department.

    I find myself in complete agreement with what Mr NK Agarwal has stated ( ref: # 232 !!
    will this thread never see an end ? ) .

    However, I do not agree with the later part , about FAAs and PIOs being from different organisations/departments . The situation will then take a complete U-turn and a game of ONEMANUPSHIP - showing down the PIO by the FAA belonging to other Department will begin and objectivity and fair justice will be the victims in the process .

    a CPIO and FAA from other department would be able to be assertive. They can act against the erring PAAs withot fear and favour.
    See how effective are the officials drawan from different departments during the process of recent parliamentary election (2009). How effective is the CRPF during law and order situation in comparisn to the local police?
    Today the situation is analogous to breach of law and order by PAs in our daily life.
    Tranasparency and accountability is no where to be found, because one is free to write anthing in the "files" and can keep it under cover in the name of "confidentiality" etc.

    Dept. of Administrative Reforms & Public Grievances has published in it's website the GoI's decisions on the recommendations of the Administrative Reforms Commission on RTI.

    This is precursor to the Proposed amendments to be carried out soon by the GoI. Watch OUT !

    CPIO must be of the same deptt. But for fairness & impartiality ; the FAA must be certainly from some other govt deptt.
    Otherwise '' No vakil, no Dalil'' principle will work. & appellant can never get due justice ; & the asked information even after 30 months.
    FAA of the same deptt never goes against his own officer.They both are like real brothers.
    They both in connivance harass the innocent , rightful RTI applicant intentionally & without fears.
