    Or he maybe referringto the gate watchers, security-staff or clerks who are not accountable in non-implementation of RTI Act efectively. I just to wish to know whether any retired service officers are employed in any accountable position in TN SIC ?

    Hi all,
    the commission should straighaway order release of all the required informations without wastage of time, as the delay in release of information takes away liberty, finance, and causes many hardships to innocent people.
    And in any case where the investigations of the deptts. like CBI, DRI, Customs, DE, etc. are over, information should be provided. Almost all of these informations are required by the seeker to represent the facts and to seek justice.

    Most of the public sector banks have designated APIO/PIO at Regional/Zonal level. For a common citizen/bank service user with no access to internet, it is difficult to locate name, designation and address of PIO for matter relating to a particular branch. Branches do not have awareness or avoid divulging details of PIOs. To facilitate filing of applications, I offer following suggestion:

    All branch managers [branch heads] of public sector banks should be designated as Asstt.PIO for all branches of the concerned bank. He will receive and acknowledge application and filing fee of Rs.10/- paid in cash. He should then forward the application within 5 days of its receipt to the concerned PIO stationed at Regional/Zonal office under whom branch to which the matter pertains, falls. All branches are having list of branches and their respective controlling Regional/Zonal offices. Duties of APIO are simple and branches are used to forwarding lots of papers to controlling offices. This facility should be given publicity through notice boards/advertisements.

    <ODesignated Post Offices are already acting as APIO for ministries/depts./offices of Central Govt. [Public sector undertakings are excluded.] Hence there should be no operational difficulties for Branch Managers to act as APIO of their own bank. I understand that Central Bank of India has designated its branch managers as APIO.

    <O<OThis suggestion should be considered as a part of improving customer satisfaction and facilitating exercise of legal right by citizens, which will in turn improve transparency, efficiency, accountability and reduce corruption. At present RTI applicant expends more time and money on locating PIO by visiting cyber cafe, demand draft commission and postal/courier charges than the filing fee. Villagers/farmers are the worst sufferers in accessing RTI mechanism. This system should be extended to public sector insurance companies and financial institutions also.<O

    Respected Sir,
    As you are aware that section 23 bars the jurisdiction of courts in the matter. It provides as under:
    "No court shall entertain any suit, application or other proceedings in respect of any order made under this Act and no such order shall be called in question otherwise than by way of appeal under this Act."
    The Act only provides that the second appeal may be preferred to the Central Information Commission or the State Information Commission, as the case may be. Section 19(7) further provides as under:-
    "The decision of the Central Information Commission or State Information Commission, as the case may be, shall be binding."
    In the above circumstances, it is crystal clear that no appeal can be filed in any court of law against the decision of the Commissions.
    NOW THE QUESTION IS : WHAT IS THE REMEDY?
    In this regard, it is submitted that the only remedy available is to file a WRIT in the High Court against the violation or FRs and other rights under Article 226 of the Constitution of India. Since the violation of rights have been due the decision of the Commissions, therefore the Commissions are required to be made a party. Article 32 of Constitution also provides that in case of the violation of FRs, one can also approach the Hon'ble SC. However, the scope of the Art. 226 is much wider than Art 32, and hence it is safer to approach the HC rather than the SC. Moreover, it is not proper to bother the Hon'ble SC in small matters.

    The application fee is very high in some states. Rate of obtainining photocopies is alse very high. For example, in HP Rs.10 is charged for a single page of A-4 size or smaller size and Rs. 20/- is charged for larger size. I think the fee for ontaining information is required to be received.

    I think it is the exclusive prerogative of the respective State Governments. The intitative to amend their Rules making the rates at par with that prevelent in CIC and most of the states should come from Activists of the states concerned. Others are helpless on this account.
