    Implementing RTI is great challenge, says HC Chief Justice


    Chandigarh, Apr 25 (UNI) Punjab and Haryana High Court Chief Justice Vijender Jain today cautioned that implementation of the Right to Information Act, 2005 posed a great challenge as disclosure of information in actual practice is likely to conflict with public interest.

    ''It poses a great challenge as disclosure of information in actual practice is likely to conflict with public interest, including efficiency of the government and preservation of confidentiality of sensitive information,'' he said while speaking at a book release here.

    In such events, he said harmonisation of conflicting interests while maintaining the democratic ideals could be the touch stone, he added.

    Mr Justice Vijender Jain and Chief Minister Bhupinder Singh Hooda released a book entitled 'A Commentary and Digest on The Right to Information Act, 2005 written by Mrs Dheera Khandelwal and Mr Krishna K. Khandelwal.' Both authors are IAS officers working with Haryana Government.

    This seems a distorted impression! Seems the authors who are poart of old bureaucratic tradition have still to realize that everything in Govt. is not a top secret affecting public interest! In fact most State Governments do precious little except waste time and money in useless transfers of officials which is hardly a State Secret affecting Public interest! They need to be more transparent for good administration as there is total lack of awareness of even good schemes of Government and those targeted do not get benefits as a result of the secrecy!Hari Gautam Obhrai.

    It appears that Justice Jain's statement that " It poses a great challenge as declaration of information in actual practice is likely to conflict with public interest " is incomplete. What he meant might be " It poses a great challenge as declaration of information in actual practice is like to conflict with PUBLIC SERVANT'S INTEREST . " This fact is a gospel truth.

    Hyperlink given by you(Karira) is really helpful in comprehending Mr.Jains statement . Well i just fail to understand why People who are vested with justice delivery system and mechanism their own transfers and appointments are being kept confidential how can we take/expect justice and transparency from such like people and system.
