  1. How to use RTI Act effectively?


    I am a new member. I submitted about 25 ap[plication alongwith my friends to different Govt. Organizations. But information received is not at all satisfactory. Dept. of Co operation sending reply after 50- 70 days sometimes , without having any regard to the act, and Co operation Directorate of West Bengal did not provide information in most cases only replied-- "there is m nothing in the records of this Directorate " In that case how to appeal ? Should I go to the Commission or to the Senior Officer of the SPIO of the Concerned Dept-- as name of the A.A is not provided. Please reply to [email link deleted]

    Abhijeet can you elaborate your question 1) which organisation you have written 2) what information you have asked 3) what reply you have received. This information will be very helpful to all the members to study the case.

    All the PIO especially BMC (BrihanMumbai Municipal Corporation) are now thinking that it will takes years for 2nd appeal to come for hearing and by that time PIO is getting tranferred.
    All the PIO are now aware that SIC never levy any penalty on the delinquent officer.

    Dear members,
    I have submitted few applications to the Co operation Dept of Govt of West Bengal. Partiocularly against a corrupt officer of that Dept., who was the Administrator of our Housing Society, and dedicated was to serve the purpose of the corrupt managing committe members of this big housing Society with more than 600 members and this is a plot based housing society. The corrupt officer is getting all support from his dept and all our applications and even to the vigilance commission did not take proper action.
    One of our member submitted the following application to the Dept SPIO.

    On the Salary bill for the month of Sept, 2003, prepared by the Accountant on September 26, 2003 Dr. Surath Biswas, the then Administrator of Metropolitan Co operative Housing Society, put his signature with order “passed for payment of Rs. 6,200.00 (Rupees six thousand two hundred) only.” He clarified his order saying “the application was submitted to the appropriate Court bearing CAN no.8180 of 2003 in FMA NO. 1230 of 2003 by the undersigned administrator and the matter was heard on 22.09.2003, when Mr. Dhilon Sarkar Ld. Advocate raised the question of enhancement of pay of the employees but the C. J. & the other Ld. Judge of the Division Bench set aside the objection and supported the expenditure towards salary as the office shall remain open on all working days as per State Govt. notification and it was necessary for day to day function and preparation for the election of the society and it is now being done as per order of the administrator no. 3 dtd. 02.09.2003. Accordingly the bill is passed for payment.”
    But it was clear from the order of CAN 8180 of 2003 there was nothing regarding the enhancement of salary of the employees of this Housing society. So this was clearly a false statement.
    • Did the RCS consider that this was an illegal and/or unethical activity on the part of Dr. Surath Biswas?
    • What action was taken against Dr Biswas by the Govt. authority for this type of activities ?
    • If not taken , when it will be taken? What was the reason of not taking proper action against him?
    The information received is given below.
    The statement made in the paragrapfs 1 &2 are the applicant's own understanding of the matter and this Directorate has nothing to comment.
    in view of the reply to the query no -1.
    Accordingly the information provided is appended below-:
    1.There is nothing on record to show that that the Registrar of Co op. Societies , West Bengal considered the activities of Dr Surath Biswas as illegal or unethical.
    2. Does not arise in view of the reply to the query no -1
    3. The question of taking anuy action at this p[oint of point of time does not arise in view of the reply to the query no -1
    Signed by the Registrar of Co op. societies W.B Dr Surath Biswas.

    The striking feature is that the complaint was against the then Joint Registrar & our the then Administrator Dr Surath Biswas----- and "information" provided by the same person Dr Surath Biswas who got two promotion of "successful corrupt practice " as our Administrator( Detail is not possible to submit.

    Now my clarification is as below-
    1.The clear xerox copy of the statement given in the 1st para of the then Administrator Dr Surath Biswas is with ous and which has been provided alongwith the next applixcation ( with his specific signature which was prominent both in that statement as well as the information provided by him as Registrar)
    2. The Xerox copy of the above mentioned High Court's Order (CAN 8180) does not at all reflect that enhancement of the salary of the Co op. staff was supported by the Hon'ble Chief Justice and his companion Judge. ( This has not yet submitted-- it will be submitted in the next application)

    So the very first comment of that corrupt person as the Registrar--"The statement made in the paragrapfs 1 &2 are the applicant's own understanding of the matter and this Directorate has nothing to comment " does not hold good at all as explained above.
    To day the applicant discussed with one Joint Secretary of the Co op. Dept and explained him with those Xerox copies - but the Joint Secretary wanted to see the Court application which was submitted by Dr S. Biswas. He was not convinced with above two documents- burt why is not known.
    I expect some useful suggestions from the experienced RTI activists like you, which is very much needed for fighiting against corruption

    There is one saying "the mouth of corrupt official is opened only catch hold his nose".

    From all this there is one very good thing which u have done is written to vigilance commissioner. But the Vigilance has not taken any proper action. Why don't you make a fresh application under RTI to Vigilance stating
    1) day to day progress made on your complaint.
    2) officer who is nominated to look into matter.
    3) Copies of his findings etc.. if any.
    Vigilance will take action on the complaint before giving any reply to your application. I think this will serve your purpose.

    No doubt you have a strong case Abhijeet, from your post, it appears that you were not able to express your self properly. When ever your prepare an appeal or go for a hearing etc. make yourself brief and to the point. Try to avoid using unnecessary references and comments. The listeners, like Jt. Secretary have brains, just give them the current points, they will do the job.
