• RTI For beginner - A simple format

      Most of the citizens of India are now aware of the tool called RTI. But how many of us have actually filed an RTI Application ?

      It is observed that most of the people who need some significant public information are afraid to file an RTI Application just because they do not know "How to start". First we must understand that RTI Application is actually a set of questions that we are asking the Public Information Officer and so, it does not have to be in a very specific formal format. This means that, to file your first RTI, you must do the following :

      Step 1 :- Prepare a list of questions. Make sure that you have numbered your questions.

      Step 2 :- Insert an introductory text which can be like a letter. It can contain some general text like - Respected Sir, Kindly provide me the following information... folowed by your questions.

      Step 3 :- Insert a footer after the questions. Here you should specify the serial number of the Postal Order which you have used as application fee. Footer can contain information regarding whether the information sought is public information. Or, whether you are a concerned party and you can also specify a reason for asking for this information (optional). Conclude your letter with your signature.

      Step 4 :- Like any other letter, you can put a subject line stating Request for information under Right to information act 2005

      Step 5:- Add the From and To fields appropriately.

      Using a paper clip, attach the postal order with your letter and put it in the envelope. Needless to say, write the address of the addressee on the envelope.

      Your RTI Application format is ready. This will of course be modified according to the information sought.

        If the information you seek is contained in the document that is held by PA, then its the duty of PIO to render resaonable assistance. E.g. If you are particular about knowing the date when a particular order was passed and not the order itself, then you can ask for the date in which that particular order was passed. He may provide you the copy of the document containing the date of order passing, or he may provide you the date in his reply.

        There are some smart PIO who would reply to you saying that it does not constitue as information.. Reply to him saying that anything that is held by PIO, or accessible by PIO is information. If he still persist on his decision, it reveals his intention of hiding truth.

        There is no such stipulation under RTI Act to enclose self addressed envelope.

        Please refer to the various State Rules available in the Guide section: Guide

        From my memory, Maharashtra has that rule.
        AP also has it...but PIOs seldom ask for the stamp envelope.

        If that company is a Public Authority, and if that loss is due to the call center of the company, and if the conversation is recorded and available on record, you may seek information from RTI Act.
        The fact is that the entire transaction is a bogus one from a private company and their object is to catch hold of greedy people and to mislead them to cheat them to make a quick buck.

        Please try to obtain information from UPTU under RTI Act as per following basic format. Kindly search in RTI guide segment in the portal and download sample application applicable to UP and fees for RTI as applicable to your state.

        Application dt.25th Feb, 2015 seeking information under RTI Act filed
        Before S.P.I.O, UPTU................... with
        RTI fee: Indian Postal Order No.....for Rs.10/- fvg. Accounts officer, UPTU payable at...

        1)Please provide time frame fixed for despatch of degrees as per citizen charter and laid down norms.
        2)Please provide Specific reasons for not despatching the B.Tech Degree to student since Nov, 11.
        3)Please provide the latest despatch of degree certificates and the relative year for which all original degrees were sent to eligible degree holders of B. Tech.
        4)Please provide the reasons for in ordinate delay.

        7)Name of the official, designation, mobile No. of the concerned official who is entrusted with this duty and action taken against him for deficiency in discharging his duties.

        Wait for 40 days and in case of no response issue Regd., legal notice to Registrar, UPTU under CP Act demanding for sending original degree within 15 days from receipt of the notice compensation of Rs.5 lakhs for deficiency of services and for inordinate delay in despatch of original degree certificate and harassment of educated unemployed young students.
        In case there is no reply for 45 days from registering your notice, file complaint before DIstrict Consumer Forum and the costs may come around Rs.500/- and you can not only succeed but several other students will also be benefitted. Please make inquiries with your class mates and ask about their position.
        Remember, all the above procedure is applicable only when you have remitted fees for original degree certificate with prescsribed form to University. Visit their website and study the rules and regulations for obtaining degree certificate in making application and payment of fees.
