Avoid unparliamentary language in your RTI

The commission came heavily on the RTI applicant who wrote “cheated by SBI” above his name and signatures.

If such behavior continues on the part of the appellant, the Commission will have no option but to take action as per the law of the land. The appellant is advised to refrain from the use of such language in his communications in future.

The Public authority stated during the hearing that the appellant was in the habit of writing unpalatable words like “cheated by the SBI” and using unparliamentary language in his RTI applications including in the present one in which he had mentioned “cheated by SBI” above his name and signatures.

Unparliamentary language

The Commission recorded that “,, constrained to note that the appellant took recourse to using highly unparliamentary language during the hearing.” The decision can be downloaded from here- CIC-MP-A-2015-002104. If you have queries in reference to Right to Information, go to our forum!

Let the information commissioner tell what to write for cheating in place of being cheated ?

  • Rajendra Bongale

How can it be? That means if some one gets cheated, then he should keep silent and should not tell that he is cheated otherwise he will be threatened. What a great justice of the land?

File an RTI in the Info commissioners office seeking explanation as to where in law is it quoted that cheating word is unparliamentary.
Looks like the the Info Commissioner or his relatives were heavily favoured by SBI

When the PM says that the previous Govt cheated in public speeches, is it unparliamentary? Let the Info. commissioner declare the PM statement as unparliamentary and he will be shown the door of his office within 24 hours. But the appellant herein has no recourse seeking action against the corrupt imprudent Commissioner. What a pity state of affairs of Indian Govt.

Cheating is an offence under our law. Then how can the word “cheated” be unparliamentary?

The appointment of retired bureaucrats or more than 60 years persons as commissioner, should be avoided to get good comment on the legal fight of a common men. The commissioners should make camp in a particular date to all the district head quarter to finalize the disputes of the concern district to create mass awareness of the RTI Act.

In the last paragraph of the order Commission recorded “The Commission is also constrained to note that the appellant took recourse to using highly unparliamentary language during the hearing. If such behavior continues on the part of the appellant, the Commission will have no option but to take action as per the law of the land. The appellant is advised to refrain from the use of such language in his communications in future”

In this the commission recorded that “appellant took recourse to using highly unparliamentary language during the hearing” Burt commission also recorded at least five time “The matter was heard by the Commission. The appellant was not present in spite of a notice of hearing having been sent to him”.

The two recordings are contrary and commission has also gone beyond its brief in castigating the Appellant without affording an opportunity of being herd on the “unparliamentary language” remark, as it was not the part of the pleadings. The commission has thus, committed the miscarriage the process of the Natural Justice !!

Can respected Commissioner show me the real meaning of the Cheated – that can be termed as Unparliamentarily? This is a common word used at regular intervals where any citizen feels that HE/SHE has been duped/misguided/betrayed by use of simple word CHEATED. Intentions of commissioner cannot be challenged as it os not possible to aces as to WHY and HOW he declared the word Cheated as Un-parliamentary. . As per dictionary version it means – धोखा दिया. I am sure commissioner will in future try to analyse his statement in orders/decisions.

These information commissioners are all idiots/traitors. Show me any one order of theirs which is correct in procedure and decision and I shall show you an exception to the above rule!
